I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence. In the late 1970s and early 1980s, I was an attorney for the Immigration and Naturalization Service. I spent a couple of years representing the government in deportation proceedings, often conducted in Federal prisons. Are there people in the U.S. who should be deported? Absolutely! I have no regrets. But even while serving as an INS Attorney, I fully realized that the man that I deported on Friday afternoon would be back in the U.S., working at his job to feed...

When you are working as fulltime employee for american client (not consultancy) then why are you worried?

So I was one of the lucky (yes a bit of sarcasm) people that got transferred in July 2007 to be receipted in California even though we sent the papers to Nebraska. In Sept 2007 they told me they are now transferring my application to Nebraska. And guess what just today I got the update on CRIS that it is now pending at the Nebraska office.
What did they go on vacation for over a year or how can it take that long to transfer something that was never supposed to be transferred in the first place, because I did send it to the correct office, they just decided to move it because of receipting back ups.

Hi All,
I got H1 B visa recently which has been processed by my consultant. Right now I am working in india. My current employer is asking me to go for an assignment to US with L1 Visa. My question is :
1) Do i get any problem for my current H1 visa, If I attend again to Embassy for L1.
Some of my friends are telling me that my current H1B visa will be cancelled in order to get L1 .. Please any one clarify my doubt...

The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. I've my current AP and EAD valid till july 2010. I would like to apply for renewal of AP and EAD.
Can I travel while my AP and EAD are in process using my existing AP and EAD(before july).

The green card backlog situation seems hopeless to me.

My friend approved PERM in EB2 have qualification 3 year B.SC + 1 Year B.Ed + 2 year MSc. total 6 years of college, filed I-140 and was denied because of education. The labor is for Masters with 0-1 year experience. But they want 4 year degree prior to masters, citing EDGE database. Now the appeal is with AAO.
My question:
1. Do he can apply with the same labor for EB3 ?. What is the chance with two I-140 with same labor ?
( He filed I-140 for EB2 with that labor before 6 months of PERM certification. The PERM certified on April 2009 )
2. Or he need to do a fresh PERM with EB3 as a backup till the AAO verdict ? (takes 22 months)

My current AP expires on July 30, 2008. I am planning to apply for renewal in Jan or Feb 2008, which is 6 months prior to expiration. I understand that nowadays it takes more than 3 months for approval.
In case of emergency, Can I travel to India with my current AP while AP renewal petition is pending?.
