I got labor cert approve on FEB10 and going to apply I-140 via preium process in Mar 15.
My Laber cert was file on April 09 and I have been paid lower than prevailing wage since the company reduce working hour and aset of company is 0
Year 2008
W2 + Net income tax return of company reach required wage
Year 2009
W2 + ballance sheet reach required wage (but net income tax return for 2009 is not availble yet)
Are they going to ask for 2009 net income tax return in March? if my company going to file tax extension this year and I also afraid that the net income in tax return may be lower than the number in balance sheet this year.
Is it posible that My case would be get approve without any RFE?

My wife is laid off and her company is going to cancel her H1B soon. h1 petition is getting expired on Oct,2009. now I am going to apply for COS to h4. If she wants get H1 status after one year can she use the same petition for H1 transfer?. or she has to apply a new H1?.

Any thoughts on transferring from BEC to PERM? I know that some folks in my company who applied recently with PERM got approval in less than a week!
I am wondering if anyone has already tried to transfer from BEC to PERM and what their experience has been?
I know that it is risky as it involves closing the pending case in BEC before opening a new one in PERM. The risk of losing the original PD is very high, especially for those of us with > 6years of H1.
DOL was supposed to get back with more clarification on the subject of transfer after gathering stakeholder comments but have not anything about it from DOL in months.

I am in US and have changed a job recently (changed status from L1 to H1 while in US). I plan to travel to india soon in Feb 2010. My passport is valid till March 2011 and my H1b approval is till 2012. Will this be a problem for me when I go for stamping in India.

It will not be "a problem"; but they will stamp your passport only till the exp date of passport (March 2011) and your I 94 (that you will get upon returning) will also be valid till March 2011 as well.

I am currently attending a college here in China. However, I have been offered some interesting jobs . These jobs require that I have a resident visa. I have been told that I can't change from a student visa to a resident visa, while in mainland China. Is this accurate? If so, is Hong Kong an option for me?

I worked for Client X in the month of April but lost my job in a week itself.(thus I dont have any pay Stubs from Comp A)Since Comp A was not able to find me a job. I found A full time job in Comp B in June 2009 , I somehow convinced Comp B to hire me as a contractor as I already have my H1-B approved thru Comp A. Thus from july 2010 I started working for Comp A again as my employer and Comp B as its Client. I am planning to go for VISA stamping in Dec 2010. My Question is
1) If they Ask for my Tax Returns and W2 for 2009 what should I answer as I just have my W2 frm Comp B
2) would there be a question of something like why havent I've been working for Comp A Since my H1 approval.
Please advice. I appreciate any kind of answer

Effective today, a US citizen applying for a US passport may present a letter from a physician that the applicant has had "appropriate clinical treatment for gender transition," and the new passport will be issued reflecting that new gender. A short-term passport can also be issued be those who are still transitioning.

For those of you who either are residents (Citizens or PRs) or Canada or have been thinking about becoming residents of Canada but working in US, please share your experience in terms of:
1. How you maintain your residency (or non-residency) in both countries.
2. What are the tax implications if you maintain residency in both countries,
specially if you own property in Canada.
I have heard stories about tax implications in Canada if you own property there even if you permanently live an work in the US. Is that true? Would you be considered a resident in Canada for tax purposes just because you own property (such as vacation homes) but live permanently in US.

There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Depends on the validity of the VISA. For example, if a person has 10 year multi entry (M) VISA, that person can enter whenever he/she wants.
For limited time frame, say 6 months validity, there should be a validity on the VISA itself, person needs to enter in that particular time frame.

It all depends if your I-140 has been filed and approved and the I-485 has been pending for 6 months+.
If your I-140 has been approved and six months have passed since the filing of the I-485 then you should have no problem working in the same/similar job capacity under AC21 provisions.
Having said that, I don't know what the USCIS would do nowadays given the really bad economy.
