Friends, Please let me know your input-
Here is my backgound -
1.Current status working on H1B 8th year extension for company A
2.Labor and I-140 is approved � EB3 PD 04/2006 - Company A
3.485 pending applied in August 2007 (> 180 days) - Company A
4.EAD & AP approved - Company A
5.Wife on H4 Status not filed for her 485 as she was not here.
I want do H1b transfer & work for another company B -(Job code & job duties are little different)
I don't want to use AC21 - just continue with Company B on H1 B transfer.
I am doing H1b transfer nothing else once dates are current will add my wife.
Am I doing something wrong or screwing up my GC process?
Please advise

Hi All,
My wife has her h4 visa stamping in a week's time. I have sent her all the documents required.
My question is, it is mandatory for her to carry my original I-797 petition and I-129?? I have sent photo copies of both the documents, but I read some where that she has to carry originals of these 2 docs. can you pls clarify??

Thanks for your reply. I was off for a month and a half to complete a paper for my Masters and have proof for the same...I was not able to juggle both work and studies....will USCIS consider this excuse to be at home studying without pay?

Ask them to re-apply PERM as soon as possible.Its faster to re-apply then get the auditted PERM outcome...

Hello,
I am currently working on H1b visa (stamped & valid till Feb 2011). My I-485 is pending (EB3, India). However, I have a need to stay on H1-B status.
If I find a new job/employer who files for an H1-B transfer:
1. Can I travel internationally immediately after getting the receipt notice? I will continue to work for my old employer till I get back from vacation.
2. In the same trip, I plan to get married and get my spouse on a H4 visa. Will getting new H4 visa be an issue in such a case?
3. Any issues at POE?

Hi,I have filed H1B during August 09 ..my priority dates became current in Sep 09 and I have filed for AOS -485 /EAD ..Should I cancel my H1B or will it automatically get canceled once I receive my EAD ?Please suggest.

Continue working on H1B. Or, if you plan to change job use EAD. No action is required for cancelling H1B.

This is my current status
I am on H1 B visa and currently working in the US. My visa expires in July, 2011.
I was sent to the US on a long term onsite assignment from the company I was working in bangalore, India. I am asked to come back to India in June 2010.
What are the implications of me quitting thecurrent job once I go back to India? Is my H1 B visa still valid?
In case if I go back to India and move to a different company, do I have to go through everything starting from filing the H1 petition to get the H1 visa?

A friend of mine was recently stuck in administrative processing from November till March 13th (he was informed about the approval on March 18th) a total timeframe of 5 months. He reached the US on March 22nd and was admitted on H1 without any issues.
He sent me the following facebook link which list at least 200 such cases of similar souls.
"Here is a link to Facebook group on visa delay the kind I had. There is a spreadsheet which lists a sample of 200 cases since Nov.

I have an I-485 that will be current soon, but I am not employed. If they approve it, will that be considered a mistake and make it invalid? Should I withdraw it? Will a letter explaining the situation be sufficient? I have another application as a dependent, just takes longer.
Are you serious? Wait until your date become current and until then do not do anything. Instead of looking for ways to withdraw your I-485, why dont you look for ways to find a job that matches your I-140 skills, so that you can use AC21 portability.
You will never know when will you get your chance to file 485 again if you withdrew it.
